2. Purpose
This legal notice governs access to and use of the Virtual Assistant service dashboard at app.asistente-virtual.net. The dashboard is a professional tool intended for organisations that have contracted the service with SYSCAD and for the people those organisations authorise. It is not aimed at consumers and offers no online contracting.
Access requires credentials. The specific rules of use are set out in the Terms of use, and cookies and local storage in the Cookie policy.
3. Intellectual and industrial property
The service software, the dashboard, its design, code and texts, and the Vicky brand and logos belong to SYSCAD or its licensors and are protected by intellectual and industrial property law. Access to the dashboard transfers no rights over them: it only allows use in accordance with the Terms of use and the contract signed.
Reproducing, distributing, transforming or reverse engineering the service or any part of it without SYSCAD's written authorisation is not permitted.
Content, data and trade marks that each customer enters or connects to the service remain theirs.
The dashboard uses the Manrope typeface, distributed under the SIL Open Font License 1.1.
4. Liability
SYSCAD takes reasonable measures to keep the service available and working correctly, but cannot guarantee the complete absence of interruptions, errors or incidents, and is not liable for failures arising from the communications network, the customer's phone system, third-party systems the customer connects to the service, or improper use of the dashboard. Any committed service level is the one stated in each customer's contract.
The voice assistant is an automated system: it may misunderstand or mistranscribe. Customers are responsible for reviewing messages, summaries and records before acting on them.
Where this site links to third-party pages, SYSCAD neither controls nor is responsible for their content.
5. Data protection
5.1 Data of dashboard users
SYSCAD acts as controller for account data (name, email address, hashed password and access logs), in order to enable and secure access to the dashboard. The legal basis is performance of the service contract and the legitimate interest in system security. Data is kept while the account is active and thereafter for the applicable limitation periods.
5.2 Data processed on behalf of the customer
For call data and the customer's contacts, SYSCAD acts as processor on behalf of each customer, who is the controller. The terms of the engagement are those of the contract signed with each customer under article 28 of Regulation (EU) 2016/679.
What is processed and what is stored, in practice:
- Call audio is not recorded or stored. It is processed in real time so the assistant can understand and reply, and then discarded.
- For each call a written record is kept: date and time, caller number, name if identified, a summary of what was discussed, the outcome, the duration and the cost.
- The written transcript of the conversation is kept for 7 days on the service server, so incidents can be investigated, and is then deleted automatically.
- If the caller leaves a message, its text is kept until the customer deletes it.
- If the customer enables that option in their assistant settings, the transcript of each call is emailed to them. From that point its retention is up to them.
- If the customer has connected their own ERP, CRM or ticketing system, the assistant queries and creates records in it using the credentials the customer configured.
5.3 Providers involved
| Provider | What for | Where |
|---|---|---|
| OVH | Hosting of the service servers | Roubaix (France), European Union |
| OpenAI | Real-time speech understanding and generation of the assistant's voice | Outside the European Economic Area, under the contractual safeguards of Chapter V GDPR |
| Meta Platforms Ireland (WhatsApp Business) | Sending booking and appointment notices by WhatsApp (phone number and notice content), only if the customer enables that channel | European Union (Ireland); transfers outside the European Economic Area may occur under the safeguards of Chapter V GDPR |
5.4 Rights
Data subjects may exercise their rights of access, rectification, erasure, objection, restriction and portability by writing to info@syscad.es, stating the right they wish to exercise. Where data is processed on behalf of a SYSCAD customer, the request will be passed to that customer, who is the controller. A complaint may also be lodged with the Spanish Data Protection Agency (www.aepd.es).
6. Governing law and jurisdiction
This legal notice is governed by Spanish law. For any dispute arising from access to or use of the dashboard, the parties submit to the courts of the city of Madrid, unless a mandatory rule provides otherwise.
7. Changes
SYSCAD may update this legal notice when the service or the applicable law changes. The version in force is always the one published on this page, with its update date.
The Spanish version of this text is the only binding one. Translations are provided for convenience only.
